Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed new rule §354.1451 under Title 1, Part 15, Chapter 354, Subchapter B, Medicaid Recovery Audit Contractor Program. 

The Medicaid Recovery Audit Contractor Program is being established to comply with §1902(a)(42) of the Social Security Act and 42 Code of Federal Regulations Part 455, to promote the integrity of the Medicaid program.  The rule will establish a program in which HHSC contracts with one or more recovery audit contractors to identify underpayments and overpayments under the Medicaid program and recover the overpayments for services provided under the Medicaid State Plan or under any waiver of the Medicaid State Plan.
