Proposed Amendment Relating to the Disproportionate Share Hospital
Reimbursement Methodology

Hearing.The Texas Health and Human Services Commission (HHSC) will conduct a second public hearing to receive comments on its proposed changes to the administrative rule codified in Title 1 of the Texas Administrative code, §355.8065, relating to the Disproportionate Share Hospital (DSH) Reimbursement Methodology.  The proposed amendment to the rule was published in the Texas Register on April 20, 2012 (37 TexReg 2823). (The Medical Care Advisory Committee meeting on Thursday, May 10, 2012, functions as the first public hearing. Notice of the first hearing appeared in the Texas Register on April 20, 2012, in the Preamble to the proposed rule. See 37 Tex. ProposalThe proposed amendment includes changes to the methodology for allocating DSH funds, which is being proposed by HHSC in response to a petition for adoption of a rule that was submitted to HHSC by the Texas Coalition of Transferring Hospitals (TCTH). TCTH hospitals provide funding for the non-federal share of payments to all hospitals under the DSH program.  Additional proposed changes (1) delete language pertaining to calculation of the hospital-specific limit, which was moved to another proposed rule; and (2) clarify current rule language and administrative processes.  The proposed changes are more fully summarized in the Preamble to the proposed rule, published in the Texas Register on April 20, 2012.
